Özet
Birbirleri ile entegre biçimde gelişen deniz ticareti ve sigortacılık süreçleri, 19. yüzyıl itibari ile ciddi gelişmeler sağlamıştır. Küreselleşme akımının etkisi ile de uluslararası ticaret işlemlerinde maliyet kaygısı ve tarafların haklarının korunması giderek daha önemli hale gelmiş, bu doğrultuda hem maliyet hem de hacim yönünden en efektif olarak görülen deniz taşımacılığı tercih edilmeye başlamıştır. Deniz araçlarının yaygın kullanımı ise deniz ticareti ve sigortacılık faaliyetlerinin gelişim süreçlerine katkı sağlamış ve dünya ekonomisi üzerinde olumlu sonuçlar elde edilmiştir. Gemi ile yapılan ticari taşımacılığa konu ürünler hareket öncesi, sonrası ve varış noktasına kadar teknik özellikleri de dikkate alınarak, düzenlenen sigorta poliçelerinin ilgili hükümleri ile mevcut ve/ya olası tüm iç ve dış risklere karşı ayrı ayrı koruma altında alınmaktadır. Bu çalışmada, dış ticaret işlemlerinin önemli bir parçası olan lojistik alanının denizcilik sektöründeki aşamalarını kapsayan ve daha güvenli şekilde ihracatın ve ithalatın yapılmasını sağlayan deniz taşımacılığı ile sigorta süreçleri arasında güçlü bir bağ olduğunu vurgulamak hedeflenmiştir. Bu kapsamda, sigortanın kim tarafından ve hangi koşullar içerisinde yapılması gerektiği açıklanacak, ayrıca deniz ticaretine konu sigorta işlemlerinin kontrol altında yürütülüp-yürütülmediğine ilişkin süreç ile uygulama aşamalarının denetlenebilir bir yapıda olup-olmadığı sorgulanacaktır.

With the impact of globalization, cost concerns and protection of the rights of the parties in international trade transactions have become increasingly important, and in this direction, maritime transportation, which is seen as the most effective in terms of both cost and volume, has begun to be preferred.The widespread use of maritime vehicles has contributed to the development processes of maritime trade and insurance activities and positive results have been achieved on the world economy. Products subject to commercial transportation by ship are separately protected against all existing and/or possible internal and external risks with the relevant provisions of the insurance policies, taking into account their technical characteristics before and after departure and also until the destination. In this study, it is aimed to emphasize that there is a strong link between maritime transportation and insurance processes, which covers the stages of logistics in the maritime sector, which is an important part of foreign trade transactions, and ensures safer exports and imports. In this context, it will be explained by whom and under what conditions the insurance should be made, and it will also be questioned whether the process and application stages of maritime trade are carried out under control or not, whether they are auditable or not.
